Terms of Use

These Terms of Use cover the kayasoftware.com website (the "Site"), the customer portal accessed through the Site, and the product/service orders placed through the Site — in short, every digital service offered by Kaya Software ("Kaya Software", "we"). Every person or entity ("User") who uses the Site or registers on the portal is deemed to have accepted these terms.

Access to the customer portal requires an account protected by email/password and two-factor authentication (2FA). The User is obligated to;

• provide accurate and up-to-date information at registration,
• not share their account password or 2FA access with third parties,
• be responsible for transactions carried out through their account, provided they notify us immediately of any unauthorized access

Product/service prices listed on the Site are in Turkish Lira (₺) and include applicable VAT; they may be updated without prior notice. An order is finalized once payment is successfully completed. Payments are processed through the PCI-DSS-compliant PayTR infrastructure, directly within PayTR's secure environment via an iframe — your card details never reach our servers at any stage. To issue an e-invoice, a tax office/tax number is requested for corporate orders and a national ID number for individual orders; this information is used solely to fulfill our invoicing obligation.

For corporate orders (placed in a merchant capacity), the right-of-withdrawal provisions under Turkey's Law No. 6502 on the Protection of Consumers do not apply. For orders placed as a consumer (individual), if the service by its nature involves personalized development/setup, or if performance has begun with the consumer's approval, the right-of-withdrawal exceptions under Article 15 of the Distance Contracts Regulation may apply. Withdrawal/cancellation conditions specific to an order are separately communicated to you before the contract is formed.

All content on this site (text, visuals, logos, trademarks, software code, and interface design) belongs to Kaya Software or its licensors; it may not be copied, reproduced, or distributed without prior written permission. The scope of use for purchased software products is separately defined in the relevant proposal/contract.

• Use the Site and portal only for lawful purposes,
• Do not make unauthorized attempts to disrupt the Site's operation, overload it, or test its security,
• Do not use another person's account or payment information without authorization

Violation of these obligations may result in the account being suspended or closed.

Kaya Software does not guarantee that the Site and portal will be accessible without interruption or error; temporary access disruptions may occur due to maintenance, updates, or force majeure. To the maximum extent permitted by applicable law, no liability is accepted for indirect damages (data loss, loss of profit, etc.). This limitation does not eliminate liability arising from willful misconduct or gross negligence.

This site may contain links to third-party websites (e.g., the PayTR payment page, WhatsApp). Kaya Software is not responsible for the content or privacy practices of these sites.

These Terms of Use may be updated from time to time to align with current legislation and changes in the scope of service. The current version is always published on this page and takes effect from the moment it is published.

These terms are governed by the laws of the Republic of Turkey. In the event of a dispute, the courts and enforcement offices of the Republic of Turkey, determined according to the general jurisdiction rules of the Code of Civil Procedure, have jurisdiction; no specific city's courts have been designated as having exclusive jurisdiction.
